Under a “dual enlistment” system, members of a state’s National Guard simultaneously enlist in the National Guard of the United States, a reserve component of the U.S. Army. A 1952 statute required gubernatorial consent before Guard members could be ordered to active duty for training. In 1986, Congress passed the Montgomery Amendment, which removed the requirement for gubernatorial consent for active-duty training outside the United States. The Governor of Minnesota challenged the amendment’s constitutionality after members of the Minnesota National Guard were ordered to a training mission in Central America without his consent. The Governor argued that the amendment violated the Militia Clauses of the U.S. Constitution (Art. I, § 8, cls. 15 & 16). These clauses grant Congress power to call forth the militia for only three specific purposes (to execute federal laws, suppress insurrections, and repel invasions) and reserve to the states the authority for training the militia. The Governor contended that peacetime foreign training fell outside these constitutionally enumerated purposes.
