Plaintiffs Deborah Perry-Rogers and Robert Rogers (the Rogerses) underwent in vitro fertilization. Their embryo was mistakenly implanted into defendant Donna Fasano, along with an embryo from Ms. Fasano and her husband. Both couples were notified of the error in May 1998. In December 1998, Ms. Fasano gave birth to two male infants, one white (biologically the Fasanos’) and one black. DNA testing confirmed the black child, Akeil, was the Rogerses’ genetic son. The Rogerses initiated legal action. To gain custody, Ms. Perry-Rogers signed an agreement granting the Fasanos visitation with Akeil, which included a liquidated damages clause. The Fasanos subsequently relinquished custody, and an order declared the Rogerses Akeil’s legal parents. However, the trial court later granted the Fasanos visitation based on the agreement and an oral order. The Rogerses appealed the visitation order, and the Fasanos appealed the custody order, challenging jurisdiction.
