Peter Smith, an experienced, advanced-intermediate skier, chose to ski the ‘North Face’ trail at Seven Springs Ski Resort, which was marked with a black diamond and the words ‘MOST DIFFICULT.’ Before descending the steepest part of the trail, known as the headwall, Smith observed that the slope was icy and that other skiers were falling. He also saw a series of unprotected, telephone-like poles used for snowmaking equipment lining the center of the headwall. Despite having the option to turn back or take a less difficult route, Smith proceeded down the headwall. He attempted to move toward the center of the slope to find better snow but fell on the ice, lost his skis, and slid into one of the unprotected poles, sustaining serious knee injuries. Smith filed a negligence action against the resort. The district court granted summary judgment for Seven Springs, and Smith appealed.
