Upland Resources’ predecessors in interest assigned their rights in an oil and gas well, the King “F” No. 2, to Petro Pro’s predecessor. The assignments conveyed all interest in the underlying leases “insofar and only insofar as said leases cover rights in the wellbore” of that specific well. At the time of the assignment, the well was producing from the deep Cleveland formation. Several years later, Upland, which retained the surrounding leasehold rights, drilled new wells on the same 704-acre unit to produce from the shallower Brown Dolomite formation. Petro Pro sued Upland for trespass and conversion, arguing the wellbore assignment granted it exclusive rights to produce from the entire 704-acre unit, or at a minimum, the right to produce from any formation accessible through the King “F” No. 2 wellbore.
