Dr. Curtis Tanabe leased commercial space from Leslie Pfeifle for a dental practice he purchased from her late husband’s estate. The lease was for five years. During the tenancy, Pfeifle’s family began using an adjacent basement area as living quarters and a workshop, leading to numerous disturbances. These included unauthorized entries into the dental office, construction noise that disrupted patient care, hazardous dirt piles in the parking area, and propane fumes entering the office through vents. Tanabe made numerous verbal complaints to Pfeifle. After the problems continued over a period of nearly two years, Tanabe secured a new location, provided written notice of his intent to terminate the lease, and vacated the premises 15 months before the lease term expired. Upon leaving, Tanabe removed dental cabinets that were screwed into the walls and connected to plumbing and electrical systems.
