Plaintiff Juan Phillips, a “subprime” borrower, obtained a residential mortgage from Defendant Associates Home Equity. The agreement stipulated that if the plaintiff initiated arbitration, she must pay the initial filing fee, though the defendant would advance this fee upon written request, subject to later reallocation by the arbitrator.
