Lodowick Post, the plaintiff, was hunting a fox with his hounds on unowned, uninhabited land. He was in “hot pursuit” and close to catching the animal. Jesse Pierson, the defendant, was aware of the ongoing chase but intercepted the fox, killed it, and carried it away for himself. Post sued Pierson for trespass on the case, claiming that his pursuit had established a property right in the fox, which Pierson then violated. The lower court found in favor of Post. Pierson appealed, arguing that Post had not acquired a property interest in the fox simply by chasing it.
