Plaintiff Pittsburgh Athletic Company, owner of the “Pirates” baseball team, granted an exclusive and valuable license to co-plaintiffs General Mills, Inc., and Socony-Vacuum Oil Company to broadcast play-by-play descriptions of its games. The games were played in Forbes Field, an enclosed park accessible only by a ticket which expressly forbade patrons from transmitting news of the game while in progress. Defendant KQV Broadcasting Co., a competing radio station, did not have a license to broadcast the games. Instead, KQV leased property outside the stadium, placing paid observers at vantage points where they could see over the fences and observe the game. These observers would then relay play-by-play information to KQV, which broadcast the descriptions to the public in real-time. KQV argued its actions were lawful as it did not trespass on the plaintiffs’ property. While KQV did not have a direct sponsor for these broadcasts, it admitted they were intended to cultivate public goodwill for the station.
