In 1994, developer Byron Darrah created a UNIX-based e-mail notification program named “Coolmail.” He distributed the software for free over the Internet by posting it on a public user site, accompanied by a user manual also bearing the “Coolmail” mark. The software was distributed under a GNU General Public License, which allows for copying and modification but is not a dedication to the public domain. Darrah received correspondence from users referencing the “Coolmail” mark. In 1995, a German company licensed the software from Darrah and included it in a commercial CD-ROM compilation sold in the United States, attributing the “Coolmail” program to Darrah. In April 1998, Techsplosion, Inc. launched a free, ad-supported web e-mail service under the mark “CoolMail.” Shortly thereafter, Planetary Motion, Inc. launched its own e-mail service named “Coolmail.” After initiating an infringement suit against Techsplosion, Planetary Motion purchased all of Darrah’s rights to his “Coolmail” software to establish priority of use. The district court granted summary judgment for Planetary Motion.
