Appellants, Joseph and Doris MacKenzie, purchased a vacant lot in a development managed by Appellee, Pocono Springs Civic Association. The deed contained a covenant requiring all property owners to pay annual dues to the Association. In 1987, the MacKenzies discovered the lot was unsuitable for an on-lot sewage system, rendering it unbuildable and, in their view, worthless. They subsequently attempted to abandon the property. Their efforts included offering the lot to the Association (which was refused), ceasing payment of property taxes and association fees, and mailing a notarized statement declaring their intent to abandon the property to all interested parties. The county was unsuccessful in selling the lot at a tax sale. The Association sued the MacKenzies to recover unpaid dues. The MacKenzies defended by claiming they had successfully abandoned the property and were no longer owners. The trial court granted summary judgment in favor of the Association.
