Plaintiff Poggi stored approximately 200 barrels of valuable wine in a cellar he rented. The building was sold to the defendant, Scott, who was informed that Poggi was a sub-tenant using the cellar. Later, two men approached Scott, offering to buy what they claimed were old, empty barrels in the cellar. Scott, believing the barrels to be junk, inspected them by tapping and concluded they were empty. He sold the barrels for $15 on the condition that the buyers clean out the entire cellar. Scott told the buyers that if the barrels contained anything, the deal would be different, indicating some suspicion. The buyers removed all the barrels, which contained Poggi’s wine, and shipped them away. Poggi discovered the loss and sued Scott for conversion. The trial court granted a nonsuit, which Poggi appealed.
