Earl Mosley, a federal postal employee, regularly engaged in a peaceful, solitary picket on the public sidewalk next to a Chicago high school. His sign protested alleged racial discrimination by the school. The City of Chicago enacted an ordinance prohibiting any picketing or demonstrating on a public way within 150 feet of a school while it is in session. However, the ordinance contained a specific exemption for “the peaceful picketing of any school involved in a labor dispute.” After being informed that he would be arrested if he continued his non-labor-related protest, Mosley ceased his picketing and filed suit. He sought declaratory and injunctive relief, arguing the ordinance violated his First Amendment rights and denied him equal protection under the Fourteenth Amendment by impermissibly favoring labor-related speech over all other forms of expression. The City conceded that Mosley’s picketing was always peaceful and orderly. The Seventh Circuit Court of Appeals found the ordinance unconstitutional on overbreadth grounds. The Supreme Court granted certiorari.
