The United States and Canada signed a 1950 treaty concerning the use of Niagara River water for power generation. The treaty specified the amount of water available to each nation but left the method of development to each country’s domestic law. In its resolution of advice and consent, the U.S. Senate included a “reservation” stating that the U.S. share of the water would not be developed under the existing Federal Power Act, but rather that “Congress shall provide for the redevelopment.” The President, the State Department, and the Canadian government all acknowledged that this reservation pertained to a purely domestic U.S. matter. The Power Authority of New York, a state agency, later applied to the Federal Power Commission (FPC) for a license to construct the power project. The FPC dismissed the application, concluding that the Senate’s reservation was part of the treaty, constituted the “Supreme Law of the Land,” and therefore divested the FPC of its jurisdiction under the Federal Power Act. The Power Authority sought judicial review.
