In the 1980s, the Republic of Peru and its state-owned bank, Banco Popular, defaulted on foreign debt. Peru subsequently entered into negotiations with its commercial creditors under the Brady Plan, an IMF-supported framework for voluntary debt restructuring. Most creditors agreed to stay their lawsuits to facilitate these negotiations. Pravin Banker Associates, Ltd. (Pravin) purchased a portion of this debt on the secondary market from Mellon Bank. When Banco Popular defaulted on payments to Pravin, Pravin sued in the Southern District of New York to enforce the debt. Peru and Banco Popular moved to dismiss or stay the action, arguing that allowing a lone creditor’s suit to proceed would disrupt the comprehensive Brady Plan negotiations. They invoked the doctrine of international comity, requesting that the court defer to Peru’s restructuring efforts. The district court granted short, temporary stays but ultimately denied an indefinite stay and granted summary judgment for Pravin. Peru appealed, arguing the court failed to properly extend comity.
