The original landlords, the Howells, leased numerous lake lots beginning in the 1970s using lease agreements they drafted themselves. The leases at issue fell into two categories: “Indefinite Term Leases,” which stated the term was “until Indefinite,” and “No End Term Leases,” which were silent on duration. Tenants made substantial improvements to their lots, allegedly based on the Howells’ oral assurances of long-term occupancy. After the property was conveyed to a new owner, Providence Land Services, LLC, Providence asserted that all such leases were tenancies at will and sought to impose new terms, including higher rent and 30-day termination provisions. The tenants sued to establish their rights to long-term leases. The trial court found the term “indefinite” was ambiguous, admitted parol evidence of the parties’ intent, and held these were 99-year leases. However, it determined that the leases silent on duration were tenancies at will. Both parties appealed the adverse rulings.
