In 1985, the U.S. Coast Guard discovered an oil sheen on Pine Run originating from an abandoned wastewater containment pit. The government incurred $430,000 in cleanup costs and sought reimbursement from Quaker State Corp. under the Clean Water Act (CWA), 33 U.S.C. § 1321(f). The pit was located on a lot where Quaker State’s lease had expired in 1975. All of its operations, including filling and covering the pit under U.S. Forest Service supervision, ceased by early 1978. The government argued Quaker State was the “owner or operator” at the time the discharge began, which it alleged was in 1977-78. Quaker State countered that it was not the owner or operator in 1985 when the spill was discovered, and that liability attaches at the time of discovery. The court found as a matter of fact that the government failed to prove the discharge began before 1978. The undisputed owner of the surface rights in 1985 was the U.S. Forest Service.
