Petitioner Quercia was tried in federal court for violating the Narcotic Act. During the trial, after government agents presented their case, Quercia testified in his own defense, offering a general denial of all charges. In his instructions to the jury, the trial judge, after a general admonition that his opinion on the evidence was not binding, made specific comments regarding Quercia’s testimony and demeanor. The judge stated: “You may have noticed…that he wiped his hands during his testimony. It is rather a curious thing, but that is almost always an indication of lying. Why it should be so we don’t know, but that is the fact. I think that every single word that man said, except when he agreed with the Government’s testimony, was a lie.” The judge did reiterate that this opinion was not binding and the jury should disregard it if they disagreed. Quercia’s counsel promptly excepted to this portion of the charge. Quercia was subsequently convicted, and the Circuit Court of Appeals affirmed the conviction. The Supreme Court granted certiorari to review the propriety of the judge’s comments.
