Defendant Bret MacFarlane approached his coworker, Plaintiff John Reynolds, from behind in their workplace break room. Reynolds, who was unaware of MacFarlane’s presence, was holding a ten-dollar bill. MacFarlane, without touching Reynolds’s body, quickly snatched the bill from Reynolds’s hand. Immediately after, Reynolds spun around to face MacFarlane, who then stated, “That was too easy,” and returned the money. Reynolds subsequently struck MacFarlane. Reynolds later filed suit, alleging assault and battery. The trial court held a bench trial and, finding MacFarlane’s testimony more credible, determined that MacFarlane never touched Reynolds’s body and that Reynolds was not aware of MacFarlane’s presence until after the bill had been taken.
