Appellee Ricenbaw owned the northwest quarter, and appellants Kraus owned the northeast quarter of a section. Natural drainage flowed east across appellants’ land. In 1900, Ricenbaw’s predecessor in title (Hannah) obtained oral permission from Kraus’s predecessor (Knutson) to install a tile drain across Knutson’s land to drain a pocket on Hannah’s land. Hannah installed the tile in 1901 at his own expense. This drain functioned effectively for over 50 years. In 1942, appellants Kraus purchased their land. Appellant Emil Kraus inspected the land before purchase but did not discover the underground tile drain until May 1943. In 1952, Kraus plugged the outlet of the tile drain on his property. Ricenbaw sought to establish his right to maintain the drain and enjoin interference. Additionally, a natural surface swale also drained overflow water from the pocket across appellants’ land, which Kraus had also obstructed. The trial court found an easement for the tile drain and ordered removal of the surface drain obstruction.
