Plaintiffs-lessors leased a building to defendants-lessees for twenty-four months for a seafood restaurant. After approximately eight months, the lessees abandoned the premises due to business failure. The lessors initially advertised for a new tenant but were unsuccessful. Subsequently, the lessors began operating their own seafood take-out business on a portion of the premises, eventually expanding to occupy the entire space and continuing operations beyond the original lease term. The lessors also renovated the property. Concurrently, the lessors sued the lessees to recover accelerated rent for the remainder of the lease term. The trial court awarded accelerated rent, and the court of appeal affirmed this portion of the judgment. The lessees sought review by the Louisiana Supreme Court.
