Plaintiffs-lessors leased a commercial building to defendants-lessees for a restaurant. After approximately eight months, the lessees abandoned the premises due to the business being unsuccessful and ceased paying rent. The lessors initially attempted to find a new tenant but failed. Subsequently, the lessors re-entered the property, began renovations, and started operating their own seafood take-out business on the premises. They eventually expanded to occupy the entire building and continued this business beyond the original lease term. While operating their business, the lessors filed suit against the original lessees to recover all future, accelerated rent due under the lease agreement. The lease contract contained a clause allowing the lessor, upon abandonment, to re-enter as the lessee’s agent for the purpose of reletting the property to a third party.
