In 1910, Eugene Holtsinger conveyed a parcel of land to the Tampa and Sulphur Springs Traction Company. The deed contained a provision stating that if the grantee ceased to use the land for “railroad purposes,” the title would “revert to and vest in the said Eugene Holtsinger and his heirs and assigns.” Six months later, Holtsinger conveyed a larger tract of land, which included the parcel previously granted to the traction company, to Henderson and Gaither. This second deed specified it was “made subject to” the earlier deed to the traction company. In 1945, the traction company abandoned the property and ceased using it for railroad purposes. The appellants, who are successors in title to Henderson and Gaither, brought an ejectment action to recover the land. The trial court sustained the defendant’s demurrer and dismissed the suit, prompting this appeal.
