John C. Ricketts, the decedent, gave his granddaughter, Katie Scothorn (plaintiff), a promissory note for $2,000 at 6% interest. Upon presenting the note, he told her, “I have fixed out something that you have not got to work any more,” and noted that none of his other grandchildren worked. Scothorn immediately quit her job as a bookkeeper, an action the court found to be a “reasonable and probable consequence” of her grandfather’s promise. The court determined there was no bargained-for exchange; Scothorn’s quitting was not a condition of the note, but a voluntary act in reliance upon it. The grandfather paid one year’s interest but died before paying the principal. His executor, Andrew D. Ricketts (defendant), refused to honor the note, arguing it was an unenforceable gratuitous promise that lacked consideration. Scothorn sued the estate to enforce the promise.
