Plaintiffs purchased 160 acres of landlocked property located within the Sandia Mountain Wilderness, accessible only by the Piedra Lisa Trail, a hiking and horse path. Defendant issued an owner’s title insurance policy which insured against loss from, inter alia, “unmarketability of the title” and “lack of a right of access to and from the land.” The policy also contained an exclusion for losses arising from government regulations restricting the use of the land. Believing they were entitled to vehicular access, Plaintiffs sued the United States to establish a vehicular right-of-way. Before that action concluded, Plaintiffs sold the property for a significant profit. They then filed a claim with the Defendant insurer, alleging their loss from the lack of vehicular access was a covered event. The insurer denied the claim, leading to the present suit for breach of contract and other claims. Plaintiffs admitted they always had pedestrian and equestrian access to the property via the trail, a right guaranteed by federal statute.
