A class of commissioned salespeople sued their employer, Opequon Motors, Inc., under the West Virginia Wage Payment and Collection Act (WPCA). The employees alleged the dealership engaged in several illegal pay practices. First, the dealership calculated commissions based on a “gross profit” figure that it artificially reduced by adding arbitrary costs to a vehicle’s cost basis without notice to the employees. Second, the dealership deducted business expenses, such as credit card processing fees and post-sale repair costs, directly from the salespeople’s earned commissions. The employees never executed formal wage assignments authorizing these deductions. Third, the dealership failed to pay holiday pay as promised in its employee handbook.
