Klaus Roessler was directed to Sarasota Memorial Hospital’s emergency room with a suspected perforated viscus. After admission, scans were taken in the hospital’s radiology department. The scans were interpreted by Dr. Lichtenstein, a radiologist on duty. Roessler did not select Dr. Lichtenstein; the hospital assigned him. Dr. Lichtenstein was an employee of SMH Radiology Associates, P.A., a group that had an exclusive contract with the hospital to provide all professional radiological services. SMH Radiology had no offices outside the hospital. Roessler alleged Dr. Lichtenstein negligently misinterpreted the scans, leading to a delay in surgery and causing severe complications. Roessler sued the hospital for medical malpractice based on vicarious liability. The hospital moved for summary judgment, arguing Dr. Lichtenstein was an independent contractor, not its agent or employee. The trial court granted summary judgment for the hospital.
