Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: New York’s highest court held that multiple acts of sexual abuse over several years constituted multiple ‘occurrences’ under liability insurance policies. This required the insured to pay a separate self-insured retention for each occurrence and allocated the settlement liability pro rata across all triggered policy periods.

Legal Significance: Established New York’s approach to defining ‘occurrence’ in long-tail sexual abuse claims, favoring a multiple-occurrence interpretation under the ‘unfortunate event’ test. It also affirmed pro rata allocation for continuous injuries and clarified that disclaimer rules do not apply to disputes over liability limits.

Case Facts & Court Holding

Key Facts & Case Background

The Roman Catholic Diocese of Brooklyn settled a lawsuit for $2 million brought on behalf of a minor who was sexually abused by a priest on multiple occasions over a six-year period (1996-2002). The abuse occurred in various locations. During this time, the Diocese was covered by several consecutive one-year commercial general liability (CGL) policies issued by different insurers, including three from National Union Fire Insurance. Each National Union policy provided a $750,000 liability limit over a $250,000 self-insured retention (SIR) that applied ‘separately to each occurrence.’ The policy defined an ‘occurrence’ as ‘an accident, including continuous or repeated exposure to substantially the same general harmful conditions.’ The Diocese sought indemnification, arguing the entire course of abuse constituted a single occurrence, requiring only one SIR payment and allowing it to collect the full settlement under one or two policies (joint and several allocation). National Union countered that each act or period of abuse was a separate occurrence, triggering multiple SIRs, and that liability must be allocated pro rata across all seven implicated policy years.

Court Holding & Legal Precedent

Issue: Under New York law, do numerous acts of sexual abuse committed by one individual against one victim over several years constitute a single ‘occurrence’ or multiple ‘occurrences’ for purposes of applying per-occurrence liability limits and self-insured retentions under CGL policies?
