Plaintiff (employer), a beauty salon owner, entered into a one-year written employment contract with defendant (employee), a hairdresser. The contract stipulated a salary of $75 per week or a 50% commission on gross receipts from his work, whichever was greater. After approximately six and one-half months, the defendant, described as having exceptional skill and talent, breached the contract and left the plaintiff’s employ. The plaintiff testified that his net profit was seven percent of the gross receipts per hairdresser. He attempted to mitigate damages by hiring two subsequent hairdressers, one of whom was a “complete loss,” and the other was not earning his salary even by the trial date. The defendant, after leaving, secured new employment as a hairdresser at a salary of $100 per week. The trial court found for the plaintiff but awarded only nominal damages of one dollar, reasoning that proof of lost profits was too vague and speculative. The plaintiff appealed the quantum of damages.
