Sandra Russo, a woman with a long history of psychiatric illness and recent hospitalization, owned approximately 12 acres of land. Shortly after her discharge, her neighbor, Mariis Goldschmidt, aware of Russo’s vulnerability, persuaded her to sell a portion of the land. Goldschmidt also connected Russo with James and Daniel Miller (buyers), who had offered a finder’s fee for real estate leads. The buyers, through Goldschmidt, met Russo and on the same day executed a contract for her remaining eight acres for $25,000, a price suggested by Goldschmidt. Russo, who was susceptible to influence and eager to fund a plan conceived with a fellow psychiatric patient, insisted on closing the deal immediately. She had no legal counsel, appraiser, or real estate broker, whereas the buyers were represented by counsel. After the sale, the buyers paid Goldschmidt a $500 finder’s fee. The price was grossly inadequate; the buyers later acquired the small parcel Goldschmidt had bought from Russo for $20,000 and subsequently sold that same parcel for $84,000. Russo sued to rescind the conveyance, alleging undue influence.
