Defendant Stacy Lescht, a reporter for American Broadcasting Companies, Inc. (ABC), secured employment as a “telepsychic” to conduct an undercover investigation of the industry. The workplace consisted of a large room with approximately 100 cubicles separated by five-foot-high partitions. While the office was not open to the general public, conversations could be overheard by coworkers in adjacent cubicles or nearby aisles. Lescht used a small camera hidden in her hat and a microphone to secretly videotape conversations with several coworkers, including plaintiff Mark Sanders. Lescht recorded two conversations with Sanders, one of which occurred in his cubicle and involved discussions of his personal beliefs and aspirations. Sanders sued for invasion of privacy by intrusion. A jury found for Sanders on the common law intrusion claim but against him on a statutory claim under Penal Code § 632, finding the conversations occurred in circumstances where they might reasonably be expected to be overheard. The Court of Appeal reversed the intrusion verdict, holding the statutory finding precluded a reasonable expectation of privacy. The California Supreme Court granted review.
