Case Brief Summary & Legal Analysis
tl;dr: A surviving settlor, acting as sole trustee, attempted to revoke a trust created jointly with his deceased wife. The court held the trust’s language, reserving revocation power to “ourselves,” required joint action, making the trust irrevocable upon the first spouse’s death.
Legal Significance: Establishes that when a trust instrument unambiguously reserves revocation power to joint settlors using plural language, that power is extinguished upon the death of one settlor. The roles of settlor and trustee are distinct, and trustee powers do not imply settlor powers.

Case Facts & Court Holding
Key Facts & Case Background
Robert and Helen Rudloff, a married couple, executed a form-book Declaration of Trust, naming themselves as joint settlors and joint trustees. The trust corpus was their home, previously held as tenants by the entireties. Their three children, including Appellant Judith Scalfaro, were named equal beneficiaries. Paragraph 5 of the trust instrument stated, “We reserve unto ourselves the power and right at any time during our lifetime to amend or revoke… The sale or other disposition by us… shall constitute… a revocation.” Paragraph 7 provided that upon the death of one trustee, “the survivor shall continue as sole Trustee.” After Helen Rudloff’s death, Robert Rudloff, as the sole surviving trustee, executed a deed conveying the property from the trust to two of the three children, excluding Scalfaro. This conveyance effectively revoked the trust. Scalfaro filed an action to quiet title, arguing her father lacked the unilateral authority to revoke the trust and that the deed was void.
