Two on-duty Providence police officers, Solitro and Saraiva, shot and killed Cornel Young, Jr., an off-duty African-American officer, mistaking him for a threat. Young was responding to a disturbance pursuant to a departmental “always armed/always on-duty” policy. Young’s mother, as administratrix of his estate, sued the City of Providence and police supervisors under 42 U.S.C. § 1983. A jury found Officer Solitro, but not Saraiva, used excessive force in violation of the Fourth Amendment. The plaintiff alleged the City was liable under Monell v. Department of Social Services for this violation due to its deliberate indifference in failing to adequately train officers on the risks of misidentification inherent in its “always armed/always on-duty” policy, and for inadequately screening Solitro before hiring him.
