General Brief

tl;dr: The Florida Supreme Court affirmed a trial court order requiring a custodial mother to foster a positive relationship between her children and their father, narrowly construing it to avoid compelling speech in violation of the First Amendment.

Legal Significance: This case establishes a custodial parent’s affirmative legal duty to encourage and nurture the child’s relationship with the non-custodial parent, balancing this duty with First Amendment protections against compelled speech.

Case Facts & Court Holding

Key Facts & Case Background

Following a contentious divorce, Laurel Schutz (mother) was awarded sole custody of the parties’ minor children. The trial court found that the mother actively alienated the children from their father, Richard Schutz, resulting in the children hating, despising, and fearing him. The evidence indicated the mother moved with the children without notifying the father, obstructed visitation, and fostered the children’s negative feelings. The trial court found the mother “breached every duty she owed as the custodial parent…of instilling love, respect and feeling in the children for their father.” Consequently, the trial court ordered the mother “to do everything in her power to create in the minds of [the children] a loving, caring feeling toward the father” and to convince them of her desire for them to see and love their father, threatening severe penalties for non-compliance. The mother challenged this order as a violation of her First Amendment rights.

Court Holding & Legal Precedent

Issue: Did the trial court’s order compelling a custodial parent to foster a loving and caring feeling in her children toward the non-custodial parent, and to express a desire for such a relationship, impermissibly infringe upon the custodial parent’s First Amendment right to free expression?
