Plaintiff Shirley Goodman and Leonard Lee performed as the musical duo “Shirley and Lee.” In 1956, they composed their biggest hit, “Let the Good Times Roll.” Goodman alleged that she co-authored the song with Lee. However, when Lee registered the work with the U.S. Copyright Office, he listed himself as the sole author. Consequently, Lee and, after his death in 1976, his heirs (Defendants Audrey and Nikki Lee) received all royalties from the song. In 1984, after the copyright was renewed, Goodman discovered she was not listed as a co-author and demanded her share of the royalties. In 1985, she filed suit seeking a declaratory judgment that she was a co-author and co-owner of the copyright under the Copyright Act, and an accounting for her share of the profits. A jury found that Goodman was a co-author and that she neither knew nor should have known until 1984 that Lee had registered himself as the sole author. The district court declared Goodman a co-owner and awarded her one-half of all royalties received by the Lees from 1976 to 1993.
