In 1981, Credithrift of America, Inc. extended a loan to the Gentrys, secured by a second deed of trust on their residence. The deed, which was properly recorded, contained a future advance clause, also known as a ‘dragnet clause,’ stating it would secure any future indebtedness. In 1983, the Gentrys refinanced, but the 1981 deed of trust was not cancelled. In October 1984, Thomas E. Shutze obtained a judgment against Mr. Gentry and properly enrolled it, creating a judgment lien on the property. Eleven months later, in August 1985, Credithrift again refinanced the Gentrys’ loan, advancing $2,784.13 in new funds. At the time of this advance, Credithrift had no actual knowledge of Shutze’s judgment lien. When the Gentrys defaulted, Credithrift foreclosed under the original 1981 deed of trust. Shutze sued, claiming his 1984 judgment lien had priority over Credithrift’s 1985 future advance.
