The City of Naperville, a municipally-owned utility provider, began replacing traditional analog electricity meters with ‘smart meters’ as part of a grid modernization program. Unlike analog meters that recorded only total monthly consumption, the smart meters collected granular energy usage data in 15-minute intervals (‘Interval Data’). A citizens’ group, Naperville Smart Meter Awareness (NSMA), sued the City, alleging this practice constituted an unreasonable search under the Fourth Amendment. NSMA claimed that the detailed Interval Data could reveal intimate details of its members’ in-home activities, such as when they were home, asleep, or using specific appliances.
