In the early 1970s, master recording tapes by musician Henry Roeland Byrd (“Professor Longhair”) were delivered to Bearsville Records, Inc. for demonstration purposes only, with no intent to transfer ownership. The delivery created a precarious possession. In 1975, Byrd’s attorney sent letters requesting the tapes’ return, to which Bearsville never responded. Years later, after the death of Bearsville’s principal, the estate licensed the master tapes to other record companies, resulting in commercial album releases in 1987 and thereafter. In 1993, SongByrd, Inc., as successor-in-interest to Byrd’s rights, was incorporated. In 1995, SongByrd filed a “Petition in Revendication” in Louisiana state court seeking recognition of its ownership, return of the tapes, and damages. After removal to federal court, the district court granted summary judgment for Bearsville, holding the claim was a personal action barred by liberative prescription (a statute of limitations).
