Plaintiff Songbyrd, Inc. was the successor in interest to musician Henry Roeland Byrd (“Professor Longhair”). In the early 1970s, master recordings of Byrd’s music came into the possession of a predecessor to defendant Bearsville Records. Bearsville’s initial possession was lawful. Over the years, Byrd’s representatives made requests for the tapes’ return, but Bearsville retained physical custody. In August 1986, Bearsville, without authorization from Byrd’s estate, licensed the master recordings to Rounder Records, which subsequently released an album in 1987. Bearsville later licensed the tapes again in 1991. Songbyrd filed a suit for conversion and other relief in 1995. The case was originally filed in Louisiana but was transferred to the Northern District of New York because the Louisiana court lacked personal jurisdiction over Bearsville. This transfer required the application of New York law to the dispute.
