The defendants, the Blackwells, owned rural property abutting a public road. A driver, Stacy Brier, was exiting the Blackwells’ driveway when her view of oncoming traffic was obstructed by tall weeds growing on a raised area of the Blackwells’ land. Unable to see, Brier pulled onto the road and was struck by the plaintiff, Tim Spears, whose view was similarly obstructed by the weeds. Spears sued the Blackwells for negligence, alleging their failure to maintain the vegetation caused the accident and his resulting injuries. The Blackwells moved for summary judgment, arguing they owed no duty to Spears because the weeds were a natural condition of the land. Evidence showed the land where the weeds grew had been previously altered by human activity, including the prior installation of a rock and juniper garden, the former presence of a nearby cornfield, and at least one instance of mowing by the Blackwells. The trial court granted summary judgment for the Blackwells, finding the vegetation was a natural condition as a matter of law.
