The plaintiffs, who stated they were unaware of the license terms, later filed a class-action lawsuit alleging the software unlawfully monitored their online activities. Netscape moved to compel arbitration, arguing that by downloading the software, the plaintiffs had accepted the terms of the license agreement. The district court denied the motion, and Netscape appealed.
