Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: A county imposed an impact fee on new homes to fund schools. The court upheld the fee’s concept but found it invalid as applied because it didn’t benefit all feepayers and included an unconstitutional exemption, which the court severed.

Legal Significance: This case established that school impact fees are permissible in Florida if they satisfy the dual rational nexus test, ensuring new development pays its proportional share for necessary public infrastructure without unconstitutionally burdening new residents.

Case Facts & Court Holding

Key Facts & Case Background

St. Johns County, facing population growth, enacted an ordinance imposing an impact fee on new residential construction to fund the expansion of public school facilities. The fee amount was calculated based on a study determining the average number of students per new dwelling and the net public cost of providing school capacity for them. The collected fees were to be placed in a dedicated trust fund for school construction. However, the ordinance was only effective in unincorporated areas and in municipalities that voluntarily entered into an interlocal agreement to collect the fee. The ordinance also contained a provision, Section 7(B), allowing developers to obtain an exemption by providing an independent study demonstrating their specific project would not generate new students, such as for an adult-only community. The Northeast Florida Builders Association challenged the ordinance’s validity, arguing it was an unconstitutional tax and violated state constitutional provisions for a uniform system of free public schools. The trial and intermediate appellate courts found the ordinance unconstitutional.
