Case Brief Summary & Legal Analysis

General Brief

tl;dr: A woman who killed her husband after he subjected her to a “night of terror” had her murder conviction overturned. The court found the State failed to disprove her self-defense claim, establishing new rules on imminence and the duty to retreat in domestic violence cases.

Legal Significance: This case modernizes West Virginia’s self-defense doctrine by holding that prior abuse is relevant to assessing imminent danger and that there is no duty to retreat from one’s home when attacked by a co-occupant, significantly impacting cases involving battered spouses.

Case Facts & Court Holding

Key Facts & Case Background

The defendant, Tanya Harden, was convicted of first-degree murder for shooting and killing her husband, Danuel Harden. At trial, she asserted self-defense, arguing the killing occurred after a “night of domestic terror.” The State conceded that the decedent, who had a blood alcohol content of 0.22%, had subjected the defendant to several hours of brutal physical and sexual abuse. This abuse included beating her with a shotgun and his fists, resulting in a nasal fracture and numerous contusions, and repeatedly threatening to kill her and the three children in the home. Testimony from the children corroborated the violence and threats. The State argued the defendant’s self-defense claim was invalid for two reasons: first, at the moment she shot him, the decedent was lying on a couch and was possibly asleep or passed out, meaning there was no imminent threat; and second, the defendant had a duty to retreat from the home during this lull in the violence. The defendant testified that the threats and abuse were continuous and that she believed the decedent would kill her and the children.
