A police officer observed Joseph Izzo’s vehicle pull into a closed gas station late at night. After Izzo left, the officer noticed a broken tail lens and an inoperable plate light and initiated a traffic stop. During the stop, the officer smelled alcohol, saw empty beer bottles, and noted Izzo’s watery, bloodshot eyes. The officer then questioned the passenger, Timothy Stutz, who had no identification. Stutz admitted to possessing marijuana in his waist bag and handed it to the officer. Based on this discovery, the officer searched the passenger compartment of Izzo’s car, finding more marijuana and paraphernalia. The officer then sought consent to search the trunk, telling Izzo he would otherwise impound the car and obtain a warrant. Izzo admitted there might be LSD in the trunk and signed a consent form. The subsequent search of the trunk revealed LSD and a shotgun. Izzo was not handcuffed during the roadside investigation and was only read his Miranda rights later at the police station.
