Harry Maddox entered a plea agreement for felony check forgery, which included a 13-month prison sentence and an agreement to a “restitution study.” The district court imposed the prison sentence but left the specific amount of restitution to be determined later. Four months after sentencing, the court issued orders requiring Maddox to pay $6,031.42 in restitution to three victims. Maddox timely filed a written challenge to the restitution amount, triggering a hearing pursuant to Minn. Stat. § 611A.045, subd. 3(b). Maddox appeared at this subsequent restitution hearing pro se. The record shows that the district court did not advise Maddox of his right to counsel for the hearing, nor did Maddox waive this right, either in writing or orally. The district court proceeded with the hearing and ultimately denied Maddox’s challenge.
