The defendant, Wellman, was living with his girlfriend and her young son, Jonathan. He was convicted of three counts of third-degree assault for three separate incidents. In February 1981, Jonathan sustained a fractured nose cartilage while in the defendant’s sole care; the defendant claimed the child fell down the stairs. In April 1981, the defendant slapped Jonathan, picked him up by his hair, and twisted his arm until it broke in two places; the defendant claimed the child fell from a truck. Medical testimony indicated this fracture was likely caused by a severe twisting force. In May 1981, Jonathan suffered a spiral fracture of the tibia, again while alone with the defendant, who claimed the child fell off a couch. A pediatric radiologist testified that both the arm and leg fractures were caused by a “severe twisting force” and that the chance of the leg fracture resulting from a fall off a couch was less than one percent. The trial court sentenced the defendant to consecutive prison terms totaling 60 months, a significant departure from the presumptive sentence.
