A collective bargaining agreement (CBA) between a union and an employer mandated final and binding arbitration for disputes over its “meaning and application.” After several employees were discharged, the union initiated a grievance. An arbitrator found the discharges were unjustified and ordered reinstatement with back pay, minus a 10-day suspension. A key complication arose because the CBA expired after the employees were discharged but before the arbitrator issued the award. The employer refused to comply, arguing the arbitrator lacked authority to grant remedies, such as reinstatement and back pay, for any period after the CBA’s expiration. The union sued to enforce the award. The District Court ordered enforcement, but the Court of Appeals reversed in part, refusing to enforce the portions of the award that applied to the post-expiration period. The Supreme Court granted certiorari.
