The plaintiffs (Strains) purchased a home from the defendants (Greens) via a warranty deed that contained no reservations. After the sale closed, the Greens removed several items, including a crystal chandelier with matching sidelights and three mirrors. The Greens had owned these items for many years and moved them between previous residences. They testified that they never intended for the items to become permanent fixtures of the house. The lighting fixtures were attached to the home’s electrical system and were replaced by the Greens with inferior substitutes upon removal. Two of the mirrors were mounted on large plywood backings that were firmly nailed to the walls; their removal damaged the plaster. A third mirror was simply hung on a hook. The trial court held the lights and mirrors were personal property based on the Greens’ testimony regarding their intent. The buyers appealed this part of the judgment.
