Plaintiffs were approximately 137 homeowners in two subdivisions approved in the 1960s and 1970s. At the time of approval, no municipal sewer lines were available, so the developer was not required to install them, and the homes were built with individual septic systems. By the late 1980s, the septic systems began failing systemically. In 1990, the defendant, Holmdel Township, decided to extend sewer lines to the developments. To partially fund the $2.7 million project, the Township passed an ordinance levying a special assessment against the benefited properties. A Sewer Assessment Commission determined the improvement resulted in a benefit of $14,700 per lot, and this assessment was confirmed. Plaintiffs filed suit, alleging in Count I that the special assessment violated their equal protection rights because the Township had previously paid for other, smaller sewer projects from general funds. In Count II, they alleged the Township was negligent in originally approving the subdivisions without requiring sewers. The Township moved for summary judgment.
