Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: A cashier was assaulted at home after work by robbers who targeted her because of her job. The court found the injury compensable under workers’ compensation because the chain of events causing the assault originated at the workplace, even though the injury occurred off-premises.

Legal Significance: This case established the “delayed-injury” or “originating cause” rule in Florida workers’ compensation. It allows recovery for off-premises injuries when the causative factors, such as an assailant’s motive, are formed entirely within the time and space limits of employment.

Case Facts & Court Holding

Key Facts & Case Background

Blanche Strother was a cashier at Morrison’s Cafeteria, responsible for handling customer payments. On two prior occasions, she had driven the manager to make bank deposits, though this was not a regular duty. Over three consecutive days, Strother observed two men loitering in the cafeteria who were not customers or employees. On the third evening, after finishing her shift, she drove directly home, a fifteen-to-twenty-minute trip. Upon arriving, she was assaulted by one of the men she had seen in the cafeteria. The assailant stole her purse and demanded “the money or deposits.” The judge of industrial claims found that the assailants had observed Strother at her job, mistakenly believed she was carrying the cafeteria’s daily receipts, and followed her from her place of employment to her home to rob her. The assault was therefore directly linked to her role as a cashier and the perception that she was in possession of her employer’s funds.
