Case Brief Summary & Legal Analysis
tl;dr: After a lower court found a defendant’s speedy trial right was violated, it credited his sentence for the period of delay instead of dismissing the case. The Supreme Court reversed, holding that dismissal of the indictment is the sole and mandatory remedy for a speedy trial violation.
Legal Significance: This case establishes the definitive and exclusive remedy for a Sixth Amendment speedy trial violation. The Court held that dismissal of the indictment is the “only possible remedy,” rejecting judicial creation of lesser, alternative remedies like sentence reduction, regardless of the defendant’s guilt.

Case Facts & Court Holding
Key Facts & Case Background
Petitioner Strunk was indicted on a federal charge of transporting a stolen vehicle while he was already serving a sentence in a Nebraska state penitentiary. A delay of 259 days occurred between the federal indictment and his arraignment. Strunk’s pretrial motion to dismiss for denial of his Sixth Amendment right to a speedy trial was denied by the District Court, and he was subsequently convicted. The Court of Appeals reversed, finding that Strunk had indeed been denied a speedy trial. However, viewing dismissal of the indictment as an “extreme” remedy, the appellate court fashioned a novel solution. It remanded the case with instructions to credit Strunk’s sentence with the 259-day period of unconstitutional delay, treating the sentence as “illegal to the extent of the delay.” The government did not file a cross-petition to challenge the finding of a speedy trial violation. The Supreme Court granted certiorari solely to determine the propriety of the remedy fashioned by the Court of Appeals.
